Code Amendment No. 01-01 - Game Arcades
The proposed code amendment consists of certain amendments to Chapter 26 (Zoning) and Chapter 5 (Amusements) of the West Covina Municipal Code related to game arcades. This hearing was opened on January 8, 2002 and public testimony was heard. The public hearing was closed and direction was given to staff for modification.

On October 3, 2001 the City Clerk's Office received a claim for inverse condemnation, trespass, dangerous condition of public property, and nuisance in the amount of $5,000,000 relating to an alleged slope failure on public property.
h) Norman L. Rickman vs. City of West Covina
On May 13, 2001 the City Clerk's Office received a claim for property damage in the amount of $1,097.02. Claimant is seeking to recover costs to repair damage to his vehicle.
i) Three Valleys Municipal Water District vs City of West Covina
On October 29, 2001 the City Clerk's Office received a claim for monetary loss relating to the sale of the City of West Covina's water system, including its interest in the Grand Avenue pipeline, to Suburban Water Systems. The amount of claim had not been determined at time of presentation.
4) Acceptance of Improvements and/or Release of Bonds

This report describes the current status of the approximately $3.8 million in City street rehabilitation projects to be completed during the 2001-2002 Fiscal Year. The first phase of this program involves the rehabilitation of residential streets. Five bids were received for this first phase (Project No. SP-02110) for the slurry seal of 75 residential streets, and the lowest responsive bid was $168,776.00. It is recommended that the City Council take the following actions:

a) Award of Bid - Section 125 Plan Third Party Administrator Contract
This contract is for professional services, to be provided by a Third Party Administrator (TPA) for the City of West Covina's Section 125 Plan (Flexible Benefits Spending Plan). It is recommended that the City Council take the following actions:
1. Accept the proposal of Barney & Barney as submitted on November 16, 2001;
2. Authorize the Mayor and City Clerk to execute an agreement with Barney & Barney to provide Section 125 Plan Third Party Administration effective March 1, 2002;
3. Authorize the City Manager to execute an amendment with the various bargaining unit's MOU to allow cash out option on excess medical benefit; and
4. Appropriate $7,350 from the General Fund Reserve to account 110-320-2550-5164 (Section 125 Administration) to administer the Section 125 Plan.
6) Miscellaneous - Public Works
a) Capital Improvement Program and Building Activity Report - Fourth Quarter 2001
This report provides for the City Council with a summary of Capital Improvement Activity and Major Building Permits issued during the fourth quarter ending December 31, 2001. It is recommended that the City Council receive and file this report.
Miscellaneous - Risk Management
b) FY 2001-2002 Liability Risk Premium Assessment
It is necessary to appropriate $130,904 from General Liability Reserves to pay the second installment of a supplemental Risk Premium Assessment, due under our Liability Risk Premium Agreement with ICRMA, for losses that occurred during Fiscal Year 1991/92. It is recommended to appropriate $130,904 from General Liability reserves (361-301) and transfer it into account 361-320-2570-6411 to pay the second installment of this Supplemental Risk Premium Assessment.
Miscellaneous - Environmental Management
c) BKK Landfill Closure Plans - Status Report
This is an updated report on the Status of Plans for BKK Landfill Closure and other related BKK matters. It is recommended that the City Council receive and file this report.
6) Miscellaneous - Office of the City Clerk
d) Destruction of Documents as Prescribed by Law
The City Clerk's Office has accumulated a batch of City documents and materials that are no longer necessary for retention or have been microfilmed. In accordance with the provisions of state law, these materials may now be destroyed. It is recommended that the City Council adopt the following resolution.

e) Applications for the Riparian and Riverine Habitat Grant Program Under the Safe Neighborhood, Clean Water, Clean Air, and Coastal Protection Bond Act of 2000
Staff is requesting authorization to apply for the Riparian and Riverine Habitat Grant Program funds via the attached Resolutions. Based on the grant requirements, the City of West Covina is eligible to apply for funds for two (2) different projects, projecting to receive up to $400,000 per project for the rehabilitation, acquisition, expansion, and development of recreational facilities. It is recommended that the City Council adopt the following resolutions:

1) IKEA Furniture Store Project in Covina: Draft Mitigated Negative Declaration
The City of Covina is currently considering a proposal o develop a new 330,000 square foot IKEA furniture store on the site of the former Montgomery Wards department store at southeast corner of Barranca Street and Workman Avenue. Covina has prepared a Draft Mitigated Negative Declaration for the project with a public comment period ending on January 25, 2002. This report provides an overview of the project, the Mitigated Negative Declaration, and comments proposed to be submitted to the City of Covina. It is recommended that the City Council authorize the submittal of comments to the City of Covina regarding the Draft Mitigated Negative Declaration of Environmental Impact for the proposed IKEA furniture store project.

Interim Report
This is to serve as an interim report to the City Council pending completion of a peer review of the Request For Proposals (RFP) and selected bid responses, as explained in the staff report. A final report will be forwarded to the City Council by the close of business on Monday, January 21, 2002. It is recommended that the City Council receive and file this interim report.

K) GENERAL ADMINISTRATION - CITY MANAGER'S OFFICE
1) Extension of Acting Personnel Director Contract
In September 2001, Kermit Francis was hired as a consultant to serve as the Acting Personnel Director until a permanent Personnel Director could be found. As the recruitment for a new Personnel Director is ongoing, it is necessary to extend the contract for the Acting Personnel Director for another five months. It is recommended that the City Council approve and authorize the City Manager to execute an extension to the contract with Mr. Francis to serve as the Acting Personnel Director, at a cost not to exceed $45,000, from January 23, 2002 to June 30, 2002 or until such time that a new Personnel Director is hired.

L) MAYOR'S REPORTS
1) Appointment to Hurst Ranch Historical Foundation
The Hurst Ranch Historical Foundation is required under their Articles of Incorporation to have two Councilmembers appointed to the Board of Directors. Mayor Ben Wong and Councilmember Steve Herfert are currently serving on the Hurst Ranch Historical Foundation Board of Directors. Mayor Wong wishes to resign his position on the Hurst Ranch Historical Foundation Board of Directors. Therefore, it is appropriate that the City Council make an appointment to fill Mayor Wong's position on the Hurst Ranch Historical Foundation Board of Directors. It is recommended that the City Council designate a Councilmember to replace Mayor Wong on the Hurst Ranch Historical Foundation Board of Directors.
