On July 17, 2002 the Planning Commission, on appeal, affirmed the decision of the Planning Director to approve architectural plans for five new single-family homes on Tentative Tract No. 52596 at 3146 E. Virginia Avenue. On appeal, the matter was heard by the City Council on August 6, 2002 and continued to allow Mayor Touhey and Councilmember Miller to meet with the applicant and appellants. The item was continued at the September 3, 2002 meeting to allow the applicant to revise the plans.

The Public Works Department and the Fire Department are requesting that the City of West Covina introduce an ordinance for the adoption of the California Building Standards Code; the 2001 Editions of the California Building Code and the California Fire Code; and, other various codes. This ordinance was introduced on September 17, 2002. The effective date of the ordinance once adopted will be October 31, 2002.

3) Claims Against the City of West Covina (deny & notify claimant)
a) Julie Scott vs. City of West Covina
On July 11, 2002, the City Clerk's Office received a claim for property damage. The amount of claim had not been determined at time of presentation. Claimant is seeking to recover costs to replace the rear window of her van.
b) Robert Thomas Leitch vs. City of West Covina
On June l4, 2002, the City Clerk's Office received a claim for personal injuries in the amount of $5,000. Claimant is seeking to recover costs he incurred for medical treatment and monetary compensation for his pain and suffering.
c) Robert A. Leitch vs. City of West Covina
On June 27, 2002, the City Clerk's Office received a claim for property damage in the amount of $169.56. Claimant is seeking to recover costs to repair damage to his residence allegedly caused by the West Covina Police Officers during the execution of a search warrant.
d) Robert A. Leitch vs. City of West Covina
On July 23, 2002, the City Clerk's Office received a claim for monetary loss in the amount of $1,127. Claimant is seeking to recover costs to replace firearms that were seized from his residence by officers of the West Covina Police Department.
e) Debbie Martinez vs. City of West Covina
On July 10, 2002, the City Clerk's Office received a claim for monetary loss in the amount of $300. Claimant is seeking to recover money that was seized by West Covina police officers during the execution of a search warrant at her residence.
f) Maria Josefina Hernandez vs. City of West Covina
On June 3, 2002, the City Clerk's Office received a claim for personal injuries relating to a trip and fall accident on a public street. The amount of claim had not been determined at time of presentation.
g) Coast National Insurance Company, Inc. vs. City of West Covina
On June 25, 2002, the City Clerk's Office received a subrogation claim in the amount of $3,035.14. Claimant is seeking to recover costs incurred to repair their insured's vehicle.
h) Reina Ruedas, a minor over the age of 14 years, by Gary N. Stern, Court appointed attorney
On May 21, 2002, the City Clerk's Office received a claim for personal injuries. The amount of claim had not been determined at time of presentation. Claimant is seeking monetary compensation for injuries relating to her fall from the roof of a building owned by the West Covina Redevelopment Agency.
i) Citrus Valley Urologic Medical Group, Inc. vs. City of West Covina
On June 13, 2002, the City Clerk's Office received a claim for property damage in the amount of $100. Claimant is seeking to recover costs incurred to repair a broken sprinkler line.
j) Angelique Perez vs. City of West Covina
On June 19, 2002, the City Clerk's Office received a claim for property damage in the amount of $500. Claimant is seeking to recover costs to repair damage to her vehicle.
4) Traffic Committee Meeting Minutes of September 17, 2002 (accept & file)
I. A request by the West Covina Unified School District that parking and stopping be prohibited on Durness Avenue east of Conlon Avenue adjacent to the school parking lot resulted in the following Traffic Committee recommendation:
That parking and stopping be prohibited on Durness Avenue east of Conlon Avenue adjacent to the school parking lot between the two driveway approaches.
II. A request by the Auto Plaza Advisory Board that parking be prohibited along the south side of Garvey Avenue south, west of Hollenbeck Avenue resulted in the following Traffic Committee recommendation:
That parking be prohibited along the south side of Garvey Avenue South, west of Hollenbeck Avenue.
5) Award of Bids
Parks Safety Netting
Project No. YP-03601 - Award of Bid
This project provides for the installation of new protective netting at Cortez Park, Shadow Oak Park, and Maverick Field/Ridge Riders Park as approved by the City Council as part of the 2002-2003 Capital Improvement Program. It is recommended that the City Council accept the bid of the RMF Development Company in the amount of $69,345.00 as submitted at the bid opening on August 29, 2002, and authorize the Public Works Director/City Engineer and City Clerk to execute an agreement with the RMF Development Company of Escondido, California, for the work to be done.

a) Initiating the March 4, 2003 General Municipal Election
In preparation for the upcoming general municipal election on March 4, 2003, it is recommended that the City Council continue to retain the services of Martin & Chapman as the election supplier and adopt the following resolutions:

b) City Pass-Through of Tax Increment
The City Council shall elect to receive tax increment payments from the City-wide Redevelopment Project Area. It is recommended that the City Council adopt the following resolution:

7) Miscellaneous - Police Department
c) On-Going West Covina Service Group Equipment Costs
Historically, the West Covina Service Group's equipment account was included in its operating budget. For the current fiscal year, this equipment was moved to the CIP budget. It was not approved. This leaves the WCSG without the ability to purchase equipment that it needs right now. This need can be easily addressed by authorizing an appropriation from available WCSG revenue, with no burden on the General Fund. It is recommended that the City Council authorize the appropriation of $100,000 in 375-320-2141-7160 from available West Covina Service Group revenue (the fund balance of Fund 375).

1) Appointment of City Council Representatives to Contract Cities Association
As part of the Fiscal Year Adopted 2002-2003 budget, the City Council approved joining the Contract Cities Association. As a member of the Contract Cities Association, the City of West Covina is allowed to designate a delegate and an alternate to serve on the Contract Cities Board. The City Council is being asked to confirm the appointments by the Mayor to the Contract Cities Association Board. This matter was continued from the September 3, 2002, City Council meeting. It is recommended that the Mayor make appointments to the Contract Cities Association described in the staff report, subject to City Council confirmation.
